Bivel Terms of Service

These Terms govern the use of the Bivel application (the "app"). By creating an account or using the app, you accept these Terms. If you do not agree, do not use the app.

⚠️ Health notice: Bivel offers guideline estimates for informational purposes and does not constitute professional medical or nutritional advice. Calories, macros and suggestions (including those generated by AI) are approximations. Consult a health professional before making significant changes to your diet or training. You use the app at your own responsibility.

1. Who we are

2. What the app is

Bivel is a nutrition and performance app that lets you log meals, workouts, hydration and weight, calculate goals and obtain analysis and suggestions through artificial intelligence. How your data is handled is described in the Privacy Policy.

3. Your account

• You need an account (email and password) to use the app.
• You must provide truthful information and keep your password secure. You are responsible for the activity on your account.
• Age: the app is not directed at children under 14. If you are under the age of digital consent in your country, you need your legal guardian's permission.

4. Acceptable use

You agree not to:

• Use the app for unlawful purposes or in a way that harms the service or other users.
• Attempt to access other people's data, breach security or circumvent usage limits.
• Automate or abuse the AI features (per-user daily usage limits apply).
• Reverse engineer or copy the app except as permitted by law.

We may suspend or close accounts that breach these Terms.

5. Your content

The data you log (meals, workouts, weight, food photos, etc.) is yours. You grant us only the licence needed to process it and show it to you within the service, including sending it to our providers (e.g. OpenAI for AI analysis) as detailed in the Privacy Policy. You can delete your content and your account at any time from within the app.

6. Subscription and payments

Bivel works on a subscription basis: there are no free features for continued use and no separate "premium" tier. After the free trial, access to the full app requires a paid subscription; the subscription gives access to every feature of the app, without distinction.

• Payment through Apple: purchases are made through the App Store; billing is handled by Apple, not by us.
• Price: €8.99/month or €49.99/year (taxes included depending on your country; the exact amount is shown by the App Store before you confirm the purchase).
• Free trial: 14 days. If you do not cancel before the trial ends, it automatically becomes a paid subscription at the price you chose.
• Automatic renewal: the subscription renews at the end of each period unless you cancel it at least 24 hours before the end of the current period.
• Cancellation: you can cancel at any time from your Apple account settings (App Store). You keep access until the end of the period already paid for (or of the trial).
• Refunds: handled by Apple according to its policies.
• Price changes: we will notify you in advance; they will not affect the period already paid for.

7. Intellectual property

Nutritional data and photographs of packaged products come from Open Food Facts and are used under its licences: ODbL for the database and CC BY-SA for the images. The credit also appears inside the app, under Settings › Legal.

The app, its brand, design and code are the property of their owner. These Terms do not transfer to you any rights over them beyond the normal use of the app.

Bivel™ is the subject of European Union trade mark application No 019415123, filed on 28 August 2026 with the EUIPO in the name of Daniel Pernas Benito, for classes 9, 42 and 44.

8. Availability and changes to the service

We make reasonable efforts to keep the app available, but the service is provided "as is" and may suffer interruptions, changes or withdrawal of features. We do not guarantee that it will be error-free or available without interruption.

9. Limitation of liability

To the extent permitted by law, we are not liable for damages arising from the use of the app's estimates or suggestions (including those generated by AI), or from health, dietary or training decisions based on them. Nothing in these Terms limits the rights that the law grants to consumers or any liability that cannot be legally excluded.

10. Termination

You can stop using the app and delete your account at any time from Settings → My account → Delete my account. We may suspend or close your account if you breach these Terms.

11. Changes to these Terms

We may update these Terms. We will publish the current version with its date; if the changes are significant, we will notify you. Continued use after a change implies acceptance.

12. Governing law

These Terms are governed by Spanish law. If you are a consumer, you retain the right to bring proceedings before the courts of your place of residence and the protection of the mandatory consumer rules of your country; nothing here requires you to waive those rights.
