Bivel Terms of Service

These Terms govern the use of the Bivel application (the "app"). By creating an account or using the app, you accept these Terms. If you do not agree, do not use the app.

2 · What the app is

Bivel is a nutrition and performance app that lets you log meals, workouts, hydration and weight, calculate goals and obtain analysis and suggestions through artificial intelligence. It includes Friends, an optional space to share what you choose with other people (section 6). How your data is handled is described in the Privacy Policy.

Who Bivel is not for. Bivel is a nutrition app for the general population. It is not designed to support a pregnancy, breastfeeding or an eating disorder (such as anorexia, bulimia or binge eating disorder), or anyone at risk of one. In those cases, its calorie targets and suggestions are not suitable without the support of a professional: check with your doctor or midwife first. If you enter it under Diet and allergies and Bivel recognises it, it will not suggest weight loss, and with an eating disorder Bivel AI will not analyse your day and will tell you where to get help.

3 · Your account

• You need an account (with email and password, or with Apple or Google) to use the app.
• You must provide truthful information and keep your password secure. You are responsible for the activity on your account.
• Age: the app is not directed at children under 14. If you are under the age of digital consent in your country, you need your legal guardian's permission. Friends is only from age 16.

4 · Acceptable use

You agree not to:

• Use the app for unlawful purposes or in a way that harms the service or other users.
• Attempt to access other people's data, breach security or circumvent usage limits.
• Automate or abuse the AI features (per-user daily usage limits apply).
• Reverse engineer or copy the app except as permitted by law.
• Post in Friends what its rules prohibit (section 6).

We may suspend or close accounts that breach these Terms.

5 · Your content

The data you log (meals, workouts, weight, food photos, etc.) and what you post in Friends is yours. You grant us only the licence needed to process it and show it to you within the service, including sending it to our providers (e.g. OpenAI for AI analysis and for the Friends filter) as detailed in the Privacy Policy. You can delete your content and your account at any time from within the app.

What you post in Friends. When you post something in Friends (a post, a comment, your profile or your photo), you also grant us a free, non-exclusive licence to store it, adapt it to the screen (for example, reduce a photo) and show it within the app to the people who can see it according to your settings, in the countries where Bivel is available. We do not use it for anything else: not in advertising, and not outside the app without asking you first. The licence ends when you delete it, leave Friends or delete your account, except for what must be kept to handle a report or because the law requires it (Privacy Policy, section 5). You are responsible for what you post: you must have the right to post it, and you may not post other people's details or photos without their permission.

6 · Friends: rules and moderation

Friends is an optional space, from age 16, for sharing what you eat, how you train and what you achieve, and for cheering each other on. To create a profile you accept the Friends rules, which you see when you create it and can always find in the Friends settings, and which form part of these Terms. What doesn't belong in Friends:

• Insults, harassment, threats or mocking anyone's body.
• Hate or discrimination based on origin, religion, sex, orientation, disability or any other reason.
• Nudity, sexual content or graphic violence. A photo in swimwear or training shirtless is fine.
• Encouraging self-harm, including extreme diets, purging or dangerous fasting, even as a challenge or a joke.
• Playing doctor: recommending diets, supplements or medication as if they were a treatment for others. Sharing what works for you is fine.
• Spam, ads or links to sell things.
• Pretending to be someone else, or posting other people's details or photos without their permission.
• Anything illegal.

How we moderate.

• Before it is saved, text and photos go through an automatic filter (OpenAI's moderation filter) that stops what appears to break the rules. It is an automated tool and can get it wrong: if it stops something it shouldn't, write to us. Editing a post sends it through the filter again.
• Reports. From the app you can report a post, a comment or a profile, with the reason, and we confirm that we have received it. If three different people report the same post or the same comment, it is hidden automatically until we review it, and we explain this to whoever posted it. A hidden or removed post cannot be edited, and one that has already been reviewed can be reported again (for example, if it is edited afterwards).
• Review by a person. Every report is reviewed by a person, within 48 hours at most. When in doubt, it stays: only what clearly breaks the rules or the law is removed, not what is annoying or a matter of opinion.
• What we can do: leave it as it is, remove the content or suspend the poster's Friends profile. The suspension only affects Friends: your Bivel account, your diary and your subscription stay the same. It has no end date, and we lift it if you appeal and we agree with you. Leaving Friends and coming back does not lift it.
• We always say why. If we remove something of yours, hide it or suspend your Friends profile, we explain it to you in the app and by email: what we have done, which rule is broken, why, whether a person or an automated system decided it, and how to appeal. We tell whoever reported it what was decided.
• Appeals. If you disagree with a decision, write to us at soporte@bivelapp.com within the following six months saying why, and a person will review it again. You can also go to the courts.
• Blocking. You can block anyone you like: neither of you sees the other again, and anything either of you left on the other's posts disappears.

Reporting illegal content without an account. Any person or entity can notify us of Friends content they consider illegal by writing to soporte@bivelapp.com with the reason, exactly where it is (the @ of whoever posted it and which post, comment or profile), their name and email, and a statement that they are reporting it in good faith. We confirm that we have received it, review it and tell you what we decide and how to appeal.

Points of contact. For users and for authorities (Articles 11 and 12 of the EU Digital Services Act), soporte@bivelapp.com, in Spanish or English. A person handles it.

If someone is in danger, call the emergency number (112 in the European Union). If a piece of content makes us suspect that someone's life or safety is in danger, we report it to the police or the competent authorities.

7 · Subscription and payments

Bivel works on a subscription basis: there are no free features for continued use and no separate "premium" tier. After the free trial, access to the full app requires a paid subscription; the subscription gives access to every feature of the app, without distinction, except as explained under "Who Bivel is not for" (section 2).

• Payment through your device's store: purchases are made through the App Store (iPhone and iPad) or Google Play (Android), depending on where you installed the app. Billing is handled by Apple or Google, not by us.
• Price: €8.99/month or €59.99/year (taxes included depending on your country; the exact amount is shown by the App Store or Google Play before you confirm the purchase).
• Free trial: 14 days. If you do not cancel before the trial ends, it automatically becomes a paid subscription at the price you chose.
• Automatic renewal: the subscription renews at the end of each period unless you cancel it at least 24 hours before the end of the current period.
• Cancellation: you can cancel at any time from the store you subscribed through: your Apple account settings (App Store) or your Google Play subscriptions. You keep access until the end of the period already paid for (or of the trial).
• Refunds: handled by Apple or Google, depending on the store you purchased from, according to their own policies.
• Price changes: we will notify you in advance; they will not affect the period already paid for.

8 · Intellectual property

Nutritional data and photographs of packaged products come from Open Food Facts and are used under its licences: ODbL for the database and CC BY-SA for the images. The credit also appears inside the app, under Settings › Legal.

The app, its brand, design and code are the property of their owner. These Terms do not transfer to you any rights over them beyond the normal use of the app.

Bivel™ is the subject of European Union trade mark application No 019415123, filed on 28 August 2026 with the EUIPO in the name of Daniel Pernas Benito, for classes 9, 42 and 44.

9 · Availability and changes to the service

We make reasonable efforts to keep the app available, but the service is provided "as is" and may suffer interruptions, changes or withdrawal of features. We do not guarantee that it will be error-free or available without interruption.

10 · Limitation of liability

To the extent permitted by law, we are not liable for damages arising from the use of the app's estimates or suggestions (including those generated by AI), or from health, dietary or training decisions based on them. Nothing in these Terms limits the rights that the law grants to consumers or any liability that cannot be legally excluded.

11 · Termination

You can stop using the app and delete your account at any time from Settings → My account → Delete my account. We may suspend or close your account if you breach these Terms.

12 · Changes to these Terms

We may update these Terms. We will publish the current version with its date; if the changes are significant, we will notify you. Continued use after a change implies acceptance.

13 · Governing law

These Terms are governed by Spanish law. If you are a consumer, you retain the right to bring proceedings before the courts of your place of residence and the protection of the mandatory consumer rules of your country; nothing here requires you to waive those rights.
